If you are behind on your payments and you want to keep your home try calling your lender and either getting a loan modification or setting up a repayment plan. If the reason you are behind on your property has been resolved then your lender will take your financials to see if you qualify for a repayment plan that will catch you up on your payments. This is usually done by adding an extra amount to each monthly payment until the delinquent amount is caught up. The amount added to each monthly payment will be determined by your lender after taking you current financial information. The bank's interest is to cure the loan as quickly as possible. They DO NOT want your home because they are not in the real estate business. They are in the loan business.

If the cause of your delinquency has not been resolved, you do have the right to sell your home because it is still your home unless it has already been foreclosed on.  If you are unable to resolve your delinquency issue and want to avoid foreclosure time is of the essence.  In Texas you have 90 days before the foreclosure process begins so if you are 1 or 2 payments behind and can not foresee in the near future being able to cure your loan with a loan repayment plan or a loan modification which ( only if your financials qualify) will put your late payments on the end of your loan then you need to act quickly.
